To create a valid Will in Washington State:
You must be 18 years or older
You must be of sound mind
The Will must be in writing
You must sign the Will (or direct someone to sign in your presence)
Washington requires:
Two or more competent witnesses who sign the Will in the testator's presence and at the testator's direction or request
Notarization is not required for validity, but a notarized self-proving affidavit (or a Declaration under Penalty of Perjury signed by the witnesses) is strongly recommended to simplify probate. Without a self-proving affidavit, your witnesses may need to appear in court to testify.
Important: Washington State does not recognize holographic (handwritten) Wills unless they meet all standard witness requirements. Your Will should be typed and properly witnessed to be valid.
Washington also allows electronic Wills (e-Wills) under specific statutory requirements, but the rules are more complex. Consult a licensed attorney if you wish to execute an electronic Will.
Our documents are prepared to comply with Washington statutory requirements under RCW 11.12.020.
If you die without a Will in Washington, you die intestate, and Washington law determines who inherits your estate. Because Washington is a community property state, intestate distribution treats community property and separate property differently.
Examples of intestate distribution:
Married with no children, parents, or siblings → Spouse inherits all community property and all separate property
Married with children → Spouse inherits all community property + one-half of separate property; children inherit the other half of separate property
Married with no children but surviving parents or siblings → Spouse inherits all community property + three-quarters of separate property; parents or siblings inherit the remaining one-quarter
Unmarried with children → Children inherit everything equally
No spouse or children → Estate passes to parents, siblings, or extended relatives
Registered domestic partners → Treated the same as a surviving spouse under Washington law
Without a Will, you lose control over:
Who serves as Personal Representative
Who inherits specific property
Guardianship of minor children
How and when assets are distributed
How community vs. separate property is handled
A properly executed Will ensures your wishes are legally documented and followed.
